Cactus Sounds makes all deliveries exclusively on the basis of these terms and conditions. It is our aim always

to work for your fullest satisfaction including our fair terms and conditions.

Data protection

Cactus Sounds uses only the really needed dates and uses these for the handling of the

order as well as for making the shopping as simple as possible for the recurring customer. The personal datas are handled confidentially by Cactus Sounds according to the law. Cactus Sounds does not forward personal data to any third parties. The client’s datas are not used under any circumstances for external advertizing or resold. We are obliged for collaboration, however, if we are asked to set customer information for legal reasons. We use the most modern safe technology in order to protect your datas against unauthorized processing. However we accept no responsibility for datas sent by internet. The transmission of the datas occurs unencodedly. The customer agrees that the post is entitled to let Cactus Sounds have his current address if the address in the database is not valid for any case.

Price/payment

All prices are in Euro and can be changed at any time without preannouncement. The customer takes note

that there can be differences in weight between indicated and ordered products. Decisive for the invoice amount is the price of the product at the moment of the entry of the order at Cactus Sounds which is imprinted also on the delivery receipt. The ordered products are paid in an online way with credit card.

Payment by bill is unfortunately not possible. Cactus Sounds accepts at the moment credit cards of

Mastercard and Visa. The payment with credit cards occurs as follows: The customer (card holder) inserts the credit card number and

the corresponding expiry date of his card online at Cactus Sounds. Then the system carries on the online authorization inquiry at the credit card organisation.

Supply conditions

The shippment of the ordered products to the indicated address is chargeable to the client and at client’s own risk. Short-run changes of delivery date or deadlines indicated by us can be possible provided that something other was arranged explicitly. If there is a delivery delay the customer will be informed immediately. A delay in delivery never leads to a reduction of the sale price. In order to deliver the product as quickly as possibly, we carry out also partial shipment. In this case no additional costs will be charged on the customer. The shipment occurs by Schweizerische Post. Products in stock (for transport problems we take no responsibility) are dispatched within a week. If the product is not in stock, we make an effort for a quickly delivery. If the delivering or service deadline is not possible because of force majeure, labor struggle, unforeseeable obstacles or other circumstances that we are not responsible, the deadline is prolonged adequately. If the delivering or service deadline ist not possible because of other than the above mentioned reasons the customer has the right to set an adequated deadline with refusal threat by letter and to resign from the contract after the deadline has expired. If the impossibility of the delivery is based on inability of the manufacturer or our subcontractor, so both (Cactus Sounds and the customer) can resign from the contract provided that the agreed delivery date is exceeded more than 2 months. In that case Cactus Sounds will pay back the already payed amount. Claims for compensation because of delay or impossibility and/or non-fulfilment, also such which arose up to retirement of the contract are not possible. Unless that a legal representative of the company Cactus Sounds did it negligently deliberately or coarsely.

Different things

From time to timeCactus Sounds informs about specific promotions and new specialties. You have the possibility to get these information or to renounce on that.

The purchase of alcoholic products is prohibited by law in Switzerland for persons under 18 years. If you buy such products, you confirm, that you are 18 years or older.

Complaints

Complaints must be made by letter within 48 hours after reception of the product, otherwise the claim to a

free substitute is not possible anymore. Exchange of the products is only possible if the customer receives the wrong products or by manufacturer’s mistakes. In this case the delivery receipt must be enclosed, otherwise a processing is not possible. It is not possible to send back the products just because the client doesn’t like the products.

Applicable Law

Our business activity is based exclusively on swiss law. In the case of disputes swiss law is exclusively applicable. The designated court is Zurich, Switzerland. We are entitled, to complain also at your general designated court.
